سونے اور چاندی کی بیع کا بیان مسکوک ہو یا غیر مسکوک ۔

عَنْ عَطَائِ بْنِ يَسَارٍ أَنَّ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ بَاعَ سِقَايَةً مِنْ ذَهَبٍ أَوْ وَرِقٍ بِأَکْثَرَ مِنْ وَزْنِهَا فَقَالَ أَبُو الدَّرْدَائِ سَمِعْتُ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ يَنْهَی عَنْ مِثْلِ هَذَا إِلَّا مِثْلًا بِمِثْلٍ فَقَالَ لَهُ مُعَاوِيَةُ مَا أَرَی بِمِثْلِ هَذَا بَأْسًا فَقَالَ أَبُو الدَّرْدَائِ مَنْ يَعْذِرُنِي مِنْ مُعَاوِيَةَ أَنَا أُخْبِرُهُ عَنْ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ وَيُخْبِرُنِي عَنْ رَأْيِهِ لَا أُسَاکِنُکَ بِأَرْضٍ أَنْتَ بِهَا ثُمَّ قَدِمَ أَبُو الدَّرْدَائِ عَلَی عُمَرَ بْنِ الْخَطَّابِ فَذَکَرَ ذَلِکَ لَهُ فَکَتَبَ عُمَرُ بْنُ الْخَطَّابِ إِلَی مُعَاوِيَةَ أَنْ لَا تَبِيعَ ذَلِکَ إِلَّا مِثْلًا بِمِثْلٍ وَزْنًا بِوَزْنٍ
عطاء بن یسار سے روایت ہے کہ معاویہ بن ابی سفیان نے ایک برتن پانی پینے کا سونے یا چاندی کا اس کے وزن سے زیادہ سونے یا چاندی کے بدلے میں بیچا تو ابوالدردا نے ان سے کہا میں نے رسول اللہ صلی اللہ علیہ وسلم سے سنا آپ صلی اللہ علیہ وسلم اس سے منع کرتے تھے مگر برابر برابر بیچنا درست رکھتے تھے معاویہ نے کہا میرے نزدیک کچھ قباحت نہیں ہے ابوالدردا نے کہا بھلا کان میرے عذر قبول کرے گا اگر میں معاویہ کو اس بدلہ دوں میں تو ان سے رسول اللہ صلی اللہ علیہ وسلم کی حدیث بیان کرتا ہوں اور وہ مجھ سے اپنی رائے بیان کرتے ہیں اب میں تمہارے ملک میں نہ رہوں گا پھر ابودردا مدینہ میں حضرت عمر کے پاس آئے اور ان سے یہ قصہ بیان کیا حضرت عمر نے معاویہ کو لکھا کہ ایسی بیع نہ کریں مگر برابر تول کر۔
Yahya related to me from Malik from Zayd ibn Aslam from Ata ibn Yasar that Muawiya ibn Abi Sufyan sold a gold or silver drinking-vessel for more than its weight. Abu'dDarda said, "I heard the Messenger of Allah, may Allah bless him and grant him peace, forbidding such sales except like for like." Muawiya said to him, "I don't see any harm in it." Abu'd-Darda said to him, "Who will excuse me from Muawiya? I tell him something from the Messenger of Allah, may Allah bless him and grant him peace, and he gives me his own opinion! I will not live in the same land as you!" Then Abu'd-Darda went to Umar ibn al-Khattab and mentioned that to him. Umar ibn al-Khattab therefore wrote to Muawiya, "Do not sell it except like for like, weight for weight."Malik said, "If, when counterpoising gold for gold or silver for silver, there is a difference of weight, one party should not give the other the value of the difference in silver or something else. Such a transaction is ugly and a means to usury because if one of the parties were permitted to take the difference for a separate price, it could be as if he had bought it separately, so he would be permitted. Then it would be possible for him to ask for many times the value of the difference in order to permit the completion of the transaction between the two parties.
